EL SEGUNDO, California – A Southern California family has filed a lawsuit against a daycare facility after surveillance footage allegedly showed a childcare worker throwing their toddler into the air before dropping him, leaving the child with a traumatic brain injury and permanent hearing loss.

The lawsuit, filed in California, accuses the daycare operating inside The Bay Club in El Segundo of negligence, fraud, battery, and intentional infliction of emotional distress. The parents claim the incident has had life-changing consequences for their young son and are seeking damages through the courts.

According to the complaint, the incident occurred on March 17, 2025, when the 23-month-old boy was being cared for at the fitness club’s childcare center. Surveillance video reportedly shows a staff member swinging the child by his arms several times before lifting him high into the air.

The lawsuit alleges that during the final lift, the employee lost her grip, causing the toddler to fall approximately six feet onto a hardwood floor. The worker is also seen falling onto the child moments later.

The parents say their son initially appeared shaken but later developed serious symptoms that required emergency medical treatment. Doctors later diagnosed him with a traumatic brain injury and permanent hearing loss, injuries the family says continue to affect his health and development.

One of the central claims in the lawsuit is that the daycare initially provided an inaccurate account of what happened. According to the complaint, the parents were first told that the employee had accidentally fallen while holding the child from a relatively low height.

However, after reviewing surveillance footage, the family says they discovered the fall was far more severe than they had been led to believe. Their attorneys argue that the alleged misrepresentation delayed the parents’ understanding of the seriousness of the incident.

The lawsuit also raises questions about the daycare’s operations, alleging that the childcare facility was represented as being exempt from California’s childcare licensing requirements. The family contends that this representation contributed to inadequate oversight and safety practices.

The Bay Club has not commented on the specific allegations because the case is ongoing. In a public statement, the company said the safety and well-being of members and their families remain its highest priority and that it takes incidents involving children seriously.

The legal case is expected to examine not only the actions of the employee involved but also the daycare’s training procedures, supervision policies, and communication with parents following the incident.

The lawsuit seeks financial compensation for medical expenses, ongoing treatment, pain and suffering, emotional distress, and other damages related to the child’s injuries.

As the case moves through the California court system, it has renewed concerns among parents about safety standards in childcare facilities and the importance of transparency when accidents involving young children occur.

If the allegations are proven in court, the case could have broader implications for childcare providers operating within private clubs and recreational facilities across California.
